Requests to participate will be accepted from groupings of economic operators (consortia). In the event of a sucessful consortium bid the contracting authority may specify that the consortium member takes a particular legal form and/or require that a single consortium member takes primary liability or that each member undertakes joint and several liability irrespective of the legal form adopted. Where a subsidiary company is used, the ultimate parent company may be required to provide a guarantee in respect of the performance of the contract by the subsidiary before acceptance.

Requests to participate must be made by completion and return of the PQQ by the date and time specified in point IV.3.4 and in accordance with the instructions set out in the PQQ. Completed PQQs submitted after the deadline may not be considered.
For consortium bids the information in section III.2 must be supplied by each consortium member bu the lead member should aggregate its members details and submit this as a single application.
Candidates are advised that the contracting authority is subject to the Freedom of Information Act 2000 ("the Act"). If a candidate considers that any of the information supplied as part of this procurement procedure should not be disclosed because of its commercial sensitivity, confidentiality or otherwise, they must, when providing this information, clearly specify the reasons for its sensitivity. The contracting authority shall take such statements into consideration in the event that it receives a request pursuant to the Act which relates to the information provided by the interested party. Please note it is not sufficient to include a statement of confidentiality encompassing all the information provided in the response.
The contracting authority shall not be responsible for any costs, charges or expenses incurred by the candidates or tenderers and accepts no liability for costs, charges or expenses, irrespective of the outcome of the competitions, or if the competition is cancelled or postponed. Bidding and bid costs are entirely at the risk of bidders and will not be refunded by the contracting authority under any circumstances.
All dates and time periods specified in this notice are only provisional and the contracting authority reserves the right to change these.
The contracting authority reserves the right to not award any or part of this contract.

VI.4.2)Lodging of appeals

Precise information on deadline(s) for lodging appeals: In accordance with Regulation 32 of the Public Contracts Regulations 2006 (Information about the contract award procedures and the application of the standstill period prior to the contract award) the contracting authority will incorporate a minimum 10 day standstill period at the point of information on the award of the contract is communicated to tenderers. This period allows unsuccessful tenderers to seek further debriefing from the contracting authority before the contract is entered into. Applicants have 2 days from the notification of the decision to request additional debriefing and that information has to be provided a minium of 3 working days prior to the expiry of the standstill period. Should such additional information be required, pleace contact Paul Connolly at FOLD Development Office (email address: paul.connolly@foldgroup.co.uk). The purpose of the standstill period is to allow the parties to apply to the courts to set aside the award decision before the contract is entered into.

If an appeal regarding the award of a contract has not been successfully resolved Regulation 47 of the Public Contracts Regulations 2006 (Enforcement of Obligations) provides for aggrieved apries who have been harmed or are at risk of harm by a breach of the rules to take action in the High Court. Any such action must be brought within 3 months. Where a contract has not been entered into, the court may order the setting aside of the award decision, or the contracting authority to amend any document and may award damages. If the contract has been entered into, the court may only award damages.
